Data protection policy
of the Nicolaus Gercken Family Foundation (referred to hereafter as “the foundation”)

3. Your rights
You have the right to know which data the foundation stores about you. You can claim your right to demand correction, deletion or modification of the data or their processing. You can claim your right to rescind authorizations towards the foundation at any time. If you supplied personal data and a consent form you have the right to rescind this consent at any time.
4. Copyright
The layout of the web site is copyrighted. Single pages and single graphics are copyrighted. Site contents may only be replicated for private use. Commercial use of site contents requires express written consent by the foundation. Contents may not be altered except by the webmaster who acts on behalf of the patronate.
5. Exclusion of liability
All contents was researched with due diligence. Nevertheless, mistakes can not be categorically excluded. The foundation does not assume legal responsibility or any form of liability for errors in the site contents.
6. Physical files
The patronate stores and manages physical files. These are stored either in the patronate office in Salzwedel or in the city archive of Salzwedel.
7. Storing personal data
The foundation stores personal data 1) of family foundation members, who have sent these data to the foundation, to prolong a family tree, to proliferate knowledge to future generations, or to prove descendency from the founder’s grandfather. Personal data are not made available to third parties. The legal basis for personal data processing is fixed in Art. 6 Abs. 1 DSGVO. 1) e.g. adress , phone, e-mail and family data such as father, mother, birth, baptism, marriage, death, photos, paintings, portraits in paper or electronic form, lists of ancestors, family trees, descendent lists, CV, publications, experience reports, plans and other files, physical documents such as framed pictures, books, certificates, originals and copies. These data may be complemented by personal data or items.
8. Electronic Communication
For every access by a user to a foundation site page and for every download of a file or image, meta data are stored in a protocol file on the server. Every data set includes data on where the request to open the page came from (referrer – URL), the name of the file, a date and time stamp, the transferred data volume, the access status (file transferred, file not found, etc.), and a description of the used browser. IP-adresses are stored in Server-Logfiles. Such data are stored to assure the web presence of the foundation. Art. 6 Abs. 1 DSGVO.
9. Electronic contents
In- or output of personal or business data (e-mail-adresses, names, physical adresses) can only occur upon the express written consent of the person acc. to Art. 6 Abs. 1 lit. a DSGVO or on the basis of a member contract basis acc. to Art 6 Abs. 1 lit. b DSGVO. Such data are treated confidentially and are not made available to third parties. A link with communication meta data as described above does not happen.
10. Cookies
Cookies are small text files, which are sent to the computer of the user by the internet together with the actually requested data. They are stored on the user’s computer. During login such session cookies are needed. This includes the establishment of a session betwen user and server, which allows navigation on the whole site or portal, without necessitating reauthorization. Validity of the cookies is limited to the duration of a site or portal visit. They are deleted upon logout. A link to personal data does not occur. User activity cannot be inferred. Passwords can be stored on the user’s computer upon his express written consent (check box). Storage of Cookies can be declined and deactivated by the user.
11. Web site visitor statistics
Anonymous statistics of web site usage is offered by the web service provider. Such data is recorded upon opening the web site. The foundation does not make such data available to third parties unless the foundation is under legal obligation or under court order to do so.
12. Linked contents
The foundation has no influence over linked sites. Use of those sites is the sole responsibility of the user.
13. E-Mail-data transfer
Some data transfer via the internet is neither error-proof nor error-corrected nor tampering-proof. Data may be read by unauthorized 3rd parties. Data may be falsified.
14. Changes of this policy
Data protection rules change from time to time. This policy will be updated accordingly.
